GDS Editor, GDS Plus and GDS Tools Terms and Conditions

Hi, welcome to GDS Editor and GDS Tools. Please read these terms carefully before using the GDS Editor or any of the tools and services provided on this site.

Definitions

GDS Editor - GDS Plus: GDS Plus is now called GDS Editor. Any reference to GDS Plus is interchangeable with GDS Editor.

GDS Tools: GDS Tools refers to any tool or digital service owned and provided by GameDeveloperStudio.com or any of its subdomains.

Us/we: GameDeveloperStudio.com, its directors, employees, partners, agents, suppliers, or affiliates.

This document primarily targets the terms and conditions for the use of GDS digital tools offered on this website. This document does not discuss website terms, which may overlap with general use of the tools and site. These terms can be found on the terms and conditions page of this site.

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with the updated effective date. Your continued use of GDS Editor or GDS Tools after such changes constitutes your acceptance of the new Terms. These terms are always accessible from the GDS editor application. Unless otherwise specified in a particular clause, these Terms apply to all levels of usage of GDS Editor and GDS Tools, including both core features and any supporter-only features. Access to certain tools and functionality may be reserved for supporters and contributors through the GDS Plus membership program. GDS Plus is a voluntary support membership and not a subscription to a commercial service. Terms related to GDS Plus membership can be found on the supporter signup page.

Acceptance of Terms

By accessing or using GDS Editor and GDS Tools, you agree to be bound by these Terms and you accept that you have acknowledged, understood, and agreed to them. If you disagree with any of the following conditions, then you may not access or use GDS Editor or make use of any GDS Tools. For clarity, the initials GDS refer to GameDeveloperStudio. GDS Editor and GDS Tools refer to both online and offline tools created and owned by GameDeveloperStudio.com. These tools include the GDS Editor browser and progressive web app and other tools found primarily in the "game dev tools" section of the site.

Support to You

Whilst we do aim to provide the best level of service, functionality, and support for all services and tools across GameDeveloperStudio.com, including GDS Editor, you acknowledge, understand, and agree that there is no guarantee of support in the event of failure, data loss, or non-availability. You are solely responsible for managing and troubleshooting any issues that may arise while using the GDS Editor and onsite tools.

You also acknowledge and understand that GDS Editor is offered "as is," and at most times the live version is almost always a "bleeding edge" release, meaning it's mostly experimental and may not yet be fully stable, making it prone to issues with any feature of its functionality.

Browser and Device Compatibility

GDS Editor and GDS Tools are optimized for modern, up-to-date WebKit-based browsers on desktop devices. We do not guarantee full compatibility with any specific browser, future browser updates, any specific browser version, operating system, device or environments. Functionality and performance may vary depending on your hardware, graphics capabilities, and browser version. You acknowledge and agree that we are not responsible for any errors, malfunctions, or degraded performance resulting from the use of unsupported or outdated browsers or systems.

Commercial use, User-Generated Content and Use of Library Assets

GDS Editor and GDS Tools allow users to import, create, edit, and export custom content, including images, designs, text, and other materials ("User-Generated Content"). You retain full ownership of any original content that you upload or create entirely on your own within the app.

However, GDS Editor also provides access to built-in asset libraries, including the Free Asset Library, Texture Asset Library, and GDS Editor Essentials Library. Any content that incorporates or is derived from these libraries—whether in whole or in part—remains subject to the Game Developer Studio Standard License and does not become the exclusive property of the user.

By using library assets, you agree to comply with the terms of that license, including any restrictions on redistribution, commercial use, or modification. You may use the resulting content according to the license terms, but you may not claim exclusive ownership or copyright over any portion that includes GameDeveloperStudio.com assets.

It is your responsibility to understand and follow the applicable license terms when using library content in your projects. If you are unsure about your rights, please refer to the Game Developer Studio Standard License or contact us at support@gamedeveloperstudio.com.

Imported Content

GDS Editor allows users to import files, including but not limited to bitmap images, SVG vector files, and various font formats. Users are solely responsible for ensuring they have the necessary rights, licenses, or permissions to upload, view, or modify such content. It is also the user's responsibility to verify that they have the appropriate rights to use any output generated by GDS Tools that includes or incorporates imported material.

GDS Editor Fonts

GDS Editor includes a selection of fonts that may be used when adding text to your scenes. The font dropdown list may display the following:

Inclusion of a font in the list does not imply that you are licensed to use it. You are solely responsible for ensuring that you have the legal right to use any selected font, including system fonts, in your content or exported work.

Please note: system fonts will only work if they are installed on your device. If a font is unavailable, your browser may automatically substitute it with a fallback. It is your responsibility to confirm that the font displayed is the one you intended to use and that your use of it complies with all relevant licensing or copyright restrictions.

GDS Editor does not verify the licensing of system fonts, imported fonts, or Google Fonts, and assumes no responsibility or liability for any unauthorized use of fonts displayed or used within the application.

Limitation of Liability

Your use of GDS Editor and GDS tools is at your own risk. These services and tools are provided on an "as is" and "as available" basis without any warranties of any kind. GameDeveloperStudio disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall GameDeveloperStudio, its directors, employees, partners, agents, suppliers, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, goodwill, or other intangible losses arising from the use or inability to use the GDS Editor or GDS Tools and services.

Users are solely responsible for their use of GDS Editor and GDS tools, including any damages or losses that may occur.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of GDS Editor or GDS Tools. In any case, the total liability for any claim relating to your use of the service shall not exceed the amount you have donated, if any, for access to the tool in the past one month prior to the claim.

You agree to defend, indemnify, and hold us harmless from any claims, losses, liability costs, and expenses (including, but not limited to, attorney's fees) arising from a violation of any third party's rights. You acknowledge and understand that you have only a limited, non-exclusive, non-transferable license to use GDS Editor and GDS Tools and services.

You acknowledge and fully understand that GDS Editor, GameDeveloperStudio.com, and any tools or services provided by this website, both online and offline, may include bugs, and you agree that you will use it carefully and avoid using it in ways that might result in any loss of your or any third party's property or information.

We shall not be liable for any damages arising from the use of any third-party services or products accessed through GDS Editor and GDS tools.

Local Storage and Data Responsibility

GDS Editor uses browser-based storage technologies such as localStorage and IndexedDB to allow you to save your work, download assets, and manage personalized content directly on your device. This data is stored locally in your browser, is not transmitted to our servers, is not accessible by us, and is not backed up by GameDeveloperStudio.com.

You are fully responsible for any content you create, modify, or store using these features. We do not monitor, access, or control the content stored in your browser, nor do we assume any responsibility for its legality, safety, or accuracy.

We do not guarantee the availability, persistence, or recoverability of locally stored data. You are responsible for regularly exporting and backing up your work to prevent loss.

We are not liable for any data loss resulting from application bugs, browser malfunctions, device failures, accidental deletions, software updates, or other technical or user-side issues.

Changes to Features and Functionality

GDS Editor is a continuously evolving tool, and changes to its functionality may occur over time as we improve the experience and adapt to new requirements.

We may modify, disable, or discontinue any part of the GDS Editor application—including features, tools, services, or content—at any time and for any reason, without prior notice.

These changes may include the removal of certain features, the introduction of new limitations, or the deprecation of functionality. Updates may be driven by performance enhancements, legal compliance, user feedback, or strategic decisions.

While we aim to provide a stable and valuable experience, we reserve the right to modify, limit, or remove features at any time. This includes features you may have previously used or accessed as part of your membership. We do not offer refunds, credits, or compensation for such changes.

Changes to Library Assets

Access to GDS Editor asset libraries, including but not limited to the GDS Essentials Library, the GDS Free Library, and the GDS Texture Library, is provided as a benefit to GDS Plus supporters. The contents of these libraries are subject to change at any time without notice. Assets may be moved, renamed, modified, or removed entirely at our discretion. We make no guarantees regarding the continued availability of any specific asset, and no liability is assumed for changes to the libraries or their contents.

Service Availability

GDS Editor and GDS Tools are actively developed experimental tools. While we strive to maintain reliable performance and uptime, we do not guarantee uninterrupted access, continuous availability, or error-free operation. The service may be temporarily unavailable due to updates, maintenance, network issues, or unforeseen technical problems. We reserve the right to modify or disable features at any time without notice. By using these tools, you agree that GameDeveloperStudio.com is not liable for any interruptions, delays, data loss, or changes in functionality that may result from such events.

User-Generated Content

GDS Editor and GDS Tools allow users to import, generate, edit, and export custom content, including images, text, vector shapes, and other user-generated material ("User Content"). You acknowledge and agree that you are solely responsible for all User Content created, imported, or otherwise made available through your use of GDS Editor and GDS Tools.

You agree not to use GDS Editor or any related tools to create, upload, share, or export any content that:

We do not monitor or moderate user-generated content and accept no responsibility or liability for any unlawful or infringing content created using GDS Editor or GDS Tools. You agree to indemnify and hold GameDeveloperStudio.com and its affiliates harmless from any claims, liabilities, damages, or legal costs arising from your use of the services in violation of this clause.

Intellectual Property and Prohibited Use

GDS Editor and GDS Tools — including their design, layout, functionality, source code, and all accompanying content (unless otherwise specified) — are the intellectual property of Robert Brooks and GameDeveloperStudio.com, and are protected by copyright, trademark, and other intellectual property laws.

You agree not to copy, reproduce, modify, adapt, translate, distribute, transmit, reverse-engineer, decompile, or disassemble GDS Editor, GDS Tools, or any part of the service.

You may not rent, lease, sublicense, resell, or otherwise provide access to GDS Editor or its tools as part of any commercial product, software suite, service, or platform without express written permission. Use of the application must be direct and individual, through the official website only.

Any unauthorized use, duplication, or redistribution of GDS Editor or GDS Tools is strictly prohibited and may result in termination of access and legal action.

Your Data While Using GDS Editor and GDS Tools

In brief, GDS Editor and GDS Tools do not transmit your images, files, keystrokes, text, or any other imported content to online servers or third-party services. All processing is done locally on your device.

Furthermore, your use of GDS Editor is not monitored. Other than standard server logs, no usage data, bug reports, or click tracking is collected.

You may choose to sign in to GDS Editor with your Game Developer Studio registered account to access certain editor features. Account-related data may be stored on our servers to enable user authentication. You agree to use GDS Editor and GDS Tools in a lawful and respectful manner. You must not:
